Terms of Use

1. Acceptance of These Terms

These Terms of Use ("Terms") form a binding agreement between you and Firefighter Rescues Alberta ("FFRA", "we", "us", "our"), a volunteer research and educational collective based in Alberta, Canada. By accessing, browsing, downloading from, or submitting information to the Site, you represent that you have read, understood and accepted these Terms and our Privacy Statement. If you do not agree, you must stop using the Site.

2. Purpose of the Site - Educational Use Only

The Site is provided for educational, research and informational purposes only. Nothing on the Site is intended to be, and should not be treated as:

• Operational direction A replacement for the standard operating guidelines, policies, procedures, directives or orders of your fire service.
• Professional advice Legal, medical, engineering, safety or insurance advice, or a recommendation of any particular tactic, tool or technique.
• Certification A training credential, competency certification or authorization to perform any fireground task.

Firefighting is inherently dangerous. Any action you take based on information from this Site is taken at your sole risk and responsibility, and you must comply with the training, policy, legislation, and chain-of-command of your own department.

3. Accuracy of Information

We strive to make the information on the Site accurate and current, but our data is aggregated from publicly reported incidents, voluntary submissions and partner organizations. Some reports may be incomplete, unverified or subject to revision. We make no warranty and give no assurance that:

• Completeness The dataset reflects every rescue, fatality or incident in Alberta.
• Current state Information on the Site is up to date at the moment you view it.
• Attribution All incidents are correctly attributed to the responding agency, cause or outcome.

If you identify an error, please contact us so we can review and correct it.

4. Intellectual Property

The Site, including its text, graphics, logos, icons, layouts, datasets, code, training materials and research outputs, is owned by Firefighter Rescues Alberta or its contributors and is protected by Canadian and international intellectual-property laws. The Firefighter Rescues Alberta name, flame mark, and any associated brand elements are trademarks of FFRA.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and view the Site for your personal, educational or internal fire-service use. You may:

• Share Share our research summaries and training material internally within your department, crediting Firefighter Rescues Alberta.
• Cite Cite our findings in academic, journalistic or governmental work with appropriate attribution.
• Link Link to pages on the Site, provided the link does not suggest endorsement we have not given.

You may not, without our prior written consent:

• Commercial exploitation Sell, sublicense, monetize or republish our content, datasets or outputs for commercial purposes.
• Scrape or mine Systematically harvest, scrape, or data-mine the Site, or use automated tools to overload it.
• Alter & redistribute Modify our content and redistribute it in a way that misrepresents its meaning, conclusions or source.
• Train AI models Use the Site or its data to train generative-AI systems without express written permission.

5. User Submissions

When you submit a rescue report, incident detail, story, photograph, message or any other content (a "Submission") through our forms or direct correspondence, you represent and warrant that:

• You have the right You own or have the necessary rights to share the Submission, and sharing it with us does not breach any law, contract, confidentiality obligation or third-party right.
• It is accurate The Submission is truthful and given in good faith, to the best of your knowledge.
• It is respectful The Submission does not contain personal identifying information of civilian victims, protected health information, defamatory statements, or anything you would not want published.

You grant FFRA a perpetual, worldwide, royalty-free, non-exclusive licence to use, reproduce, aggregate, de-identify, analyze and publish your Submission for research, educational and advocacy purposes consistent with our Privacy Statement. Where feasible, we will anonymize submissions before any public release.

We reserve the right, but have no obligation, to review, redact, refuse or remove any Submission at our sole discretion.

6. Prohibited Conduct

You agree not to use the Site to:

• Break the law Violate any applicable federal, provincial, municipal or international law or regulation.
• Harm others Harass, threaten, defame or impersonate any person or agency.
• Compromise the Site Introduce viruses or malware, attempt to gain unauthorized access, circumvent security measures, or otherwise interfere with Site operations.
• Misrepresent data Republish our data in a way that is intentionally misleading or used to disparage a firefighter, department or victim.

7. Third-Party Links & Services

The Site contains links to third-party websites, forms and services, including Google Forms, Google Sheets, sponsor pages and the social media accounts of our partners. We do not control those services, do not endorse their content, and are not responsible for their practices. Your use of any linked service is at your own risk and subject to that service's own terms and privacy policy.

8. Disclaimers

THE SITE AND ALL CONTENT, DATA, TRAINING MATERIALS AND RESEARCH OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, UNINTERRUPTED OPERATION, AND FREEDOM FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not warrant that information on the Site is accurate, complete, or suitable for any particular fireground scenario, and you should not rely on it as the sole basis for any operational decision.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FIREFIGHTER RESCUES ALBERTA, ITS VOLUNTEERS, DIRECTORS, CONTRIBUTORS, PARTNERS AND SPONSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the minimum extent permitted by law.

10. Indemnification

You agree to defend, indemnify and hold harmless Firefighter Rescues Alberta and its volunteers, directors, contributors, partners and sponsors from and against any claim, liability, damage, loss or expense (including reasonable legal fees) arising from (a) your breach of these Terms, (b) your misuse of the Site or its content, or (c) your Submissions.

11. Changes to the Site & Terms

We may modify, suspend or discontinue any part of the Site at any time without notice, and we may update these Terms from time to time. Material changes will be announced on the Site and the "Last updated" date above will be revised. Your continued use of the Site after changes take effect means you accept the revised Terms.

12. Termination

We may suspend or terminate your access to the Site at any time, for any reason, including if we believe you have violated these Terms. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability and Indemnification) will survive.

13. Governing Law & Disputes

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Site will be resolved exclusively in the courts located in Alberta, and you consent to their personal jurisdiction.

14. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Statement, constitute the entire agreement between you and Firefighter Rescues Alberta regarding the Site and supersede any prior agreements on the same subject.
